GENERAL ADMISSION CONDITIONS
The (“Event”) is owned by the Irving
Soccer Association. (“ISA”). For the purposes of these
conditions the Event includes car parking areas.
All persons entering the Event (“Visitors”) are admitted subject
to the conditions set out below.
Events
1. ISA reserves the right to vary programs, seating arrangements,
other conveniences and attractions and determine and publish additional
conditions in connection with the Event.
Photography and Recordings
2. The use of cameras and film recording equipment at the Event and
the making of visual representations of the Event is either restricted or
prohibited altogether.
The reasons for this are:
▪ Security
They may jeopardise the security of
Visitors and the Event itself.
▪ Copyright and Designs
The Event owns copyright and design
rights. Photographs and other visual reproductions could be used for commercial
projects resulting in losses of revenue to the Event.
▪ Third Parties
ISA has entered into commercial
agreements with third parties which may restrict or preclude altogether the use
of the rights of those parties. Where subject matter is protected by copyright
or design rights, it may not be reproduced in any form without the permission
of the owner of those rights.
▪ Loss of Retail Revenue
Visitors are encouraged to buy
mementoes in the form of videos, postcards, books etc. from outlets in the Event.
▪ Misrepresentations
ISA can be misrepresented when images
are taken or made and used without permission together with inaccurate
information about the Event.
3. Visitors are permitted to take snap shots within the Circuit, but
strictly without the use of a tripod and on condition that the photograph or
recording is used solely for the private enjoyment of the person taking the
photograph or recording.
4. Films, photographs and the making of other visual representations,
such as drawings, for any commercial purpose are not permitted without ISA’s
prior consent and by prior arrangement with ISA.
5. Visitors acting in breach of condition 3 or 4 must deliver up to ISA
any films, representations and other recordings to ISA and the Visitor assigns
(by way of present assignment of future copyright), the copyright in all such
items.
6. Applications can be made to take photographs or make drawings for
private educational research, if copyright or design rights allow. Such requests
need to be made in writing to the ISA
7. From time to time ISA or other authorized parties carry out
photography or make video or sound recording or other visual impressions in the
Event which may feature Visitors. By entering the Event Visitors agree that ISA
or any authorized party may use such recordings and images in perpetuity and
for any purpose without compensation or payment of any kind.
Loss of Admission Rights
8. ISA reserves the right to refuse admission or eject from the Event
without refund any person who:
(a) whose presence within the Event may in the opinion of ISA be
a source of danger, nuisance or annoyance or otherwise give rise to concerns in
relation to safety and security arrangements;
(b) who fails to comply with instructions from any police
officer or steward;
(c) who is in possession of any article which may be used as a
weapon or missile;
(d) who appears to be under the influence of alcohol or drugs;
(e) who is suspected of committing or being likely to commit, or
having committed, a criminal offence within the Event;
(f) who enters an area prohibited to the Visitor or damages,
interferes with the property of ISA or anyone else;
(g) who climbs over any fences or other structures without
express permission; or
(h) breaches the requirements of any of these conditions.
Exclusion of Liability
9. Visitors are reminded and agree that certain activities associated
with the Event can be dangerous and accidents can happen.
10. Visitors are warned that there is the possibility of an accident
causing injury, death or property damage or loss and anyone attending the Event
do so at their own risk. Visitors acknowledge that the risks associated with
attending or participating in the Event include, but are not limited to, the
risk of suffering harm as a result of:
(a) motor vehicles (or parts of them) colliding with other motor
vehicles, persons or property;
(b) acts of violence and other harmful acts (whether intentional
or inadvertent) committed by persons attending or participating in the Event;
and
(c) the failure or unsuitability of facilities (including
grandstands, fences and guard rails) to ensure the safety of persons or
property at the Event.
11. Visitors acknowledge that entry to and remaining in the Event has
a degree of danger and to the extent permitted by law hereby exclude, release
and forever discharge ISA, Event sponsors and all others involved in the
organization, conduct and promotion of the Event (“Associated Entities”)
from all liability for claims, loss, damage, costs or expenses arising from or
connected with the Event and admission to the Circuit.
12. Visitors also acknowledge that the Associated Entities do not
warrant that services at the Event will be provided with due care or that any
materials provided in connection with those services will be fit for the
purposes for which they are supplied. Visitors acknowledge that to the extent
that any warranty from the Associated Entities is implied in relation to those
Services, it is excluded to the full extent permitted by law.
Security
13. ISA reserves the right to conduct security searches of Visitors to
ensure the safety of patrons and the Event.
14. ISA also reserves the right in the interests of public safety to
request Visitors to leave the Event at any time for safety reasons.
Unauthorised Merchandising and
Trading
15. No unauthorized merchandising or trading is permitted within the Event.
Seating, Viewing
Areas etc.
16. ISA reserves the right to determine actual and final location of
and details concerning seating and viewing areas and other conveniences and
attractions without notice.
17. Visitors acknowledge that natural or other obstructions may impede
viewing in some areas of the Event.
Severance
18. If anything in these conditions is unenforceable, illegal or void,
then it is severed and the rest of the conditions remain in force
